EPA’s External Civil Rights and Compliance Office (ECRCO) released new guidance on how the office will prioritize and select affirmative compliance reviews. The guidance follows a report from the EPA’s Office of Inspector General in September 2020 that highlighted ECRCO’s lack of proactive compliance reviews and lack of information collection from federal funding recipients as key drivers of ECRCO’s failure to adequately enforce civil rights laws. The guidance states that ECRCO will consider input from impacted communities and stakeholders and data on disproportionate impacts from sources like EJSCREEN when prioritizing which federal funding recipients will be subject to affirmative compliance reviews.
