“In general, there are several parts of the act where the EPA sets standards based on the statutory requirements to protect public health and the environment,” says Carrie Jenks, executive director of Harvard Law School’s Environmental and Energy Law Program. “States implement those requirements, but can often use their own authority to do more to limit emissions.”
