Following Trump’s announcement yesterday, Joseph Goffman, an Obama-era EPA official now at Harvard University, wrote on Twitter: “So does this mean that the letters, memos, and guidance through which EPA has weakened the Clean Air Act NSR and Good Neighbor programs are all going to be withdrawn?”

“I’m not aware of an EPA administrator coming down on a state like this,” said Joe Goffman, head of the Harvard Environmental & Energy Law Program and an EPA veteran who most recently served the Obama administration as a top Clean Air Act lawyer.

“Even if she hadn’t worked specifically on the Clean Power Plan, her consummate professionalism would make her an appealing detailee for the ranking member of the Senate Environment and Public Works Committee,” said Goffman, now executive director of the Environmental & Energy Law Program at Harvard Law School, about Schmidt.

“The reality is that this litigation will be the third time that the D.C. Circuit will be hearing a dispute about what counts as the best system of emissions reductions from power plants under Section 111(d) [of the Clean Air Act],” said Joseph Goffman, a former senior EPA official under the Obama administration.
