The Limits of Deference: Judicial Review of Pretextual National Security Rationales


Courts generally afford the executive branch wide deference in matters of national security in recognition that one of the executive branch’s primary responsibilities is to oversee our military and national defense. However, courts have also cautioned that a hands-off approach may create an incentive for the executive branch to use national security grounds to insulate its decisions from meaningful judicial review.

The second Trump administration has cited national security as the principal justification for several actions, including actions that will have environmental implications. In asserting this justification, the administration has offered limited explanation for why national security is implicated or how the administration’s actions will address such a risk.

There is limited case law addressing the intersection of judicial review under the Administrative Procedure Act’s arbitrary and capricious standard and judicial forbearance on national security issues. Nonetheless, we are seeing courts reinforce that they can probe official explanations for agency decisions, even when they rest on national security rationales. These decisions also highlight the legal vulnerabilities in policies that arise after an administration clearly articulates its policy goal without an apparent connection to national security, and later relies upon a “national security” rationale for the agency action implementing the resulting policy.

This paper explores the tension between judicial review and courts’ longstanding deference to agencies’ national security justifications, identifies the administration’s unusual and expansive reliance on national security rationales, and describes how courts are responding to those rationales.

SBA Claims Broad Legal Authority to Preempt State and Local Building Requirements for Disaster Loan Borrowers


On January 29, 2026, the Small Business Administration (SBA) issued an interim final rule preempting state and local building requirements that the agency determined delayed disaster rebuilding efforts. As a result, states and local governments may be unable to enforce their building codes and other health and safety requirements following a disaster.

SBA published its rule without first providing an opportunity for public comment and offered only four sentences of legal analysis to justify its preemption authority. The rule also cites minimal evidence to support its repeated assertions that state and local building requirements materially delay disaster rebuilding efforts — a key factual premise for both its claimed preemption authority and its decision to bypass standard notice-and-comment rulemaking procedures.

This analysis summarizes SBA’s Disaster Loan Program, explains the new preemption framework, and describes the legal risks that may be raised if it is challenged in court.

An Endangered Species Act Exemption Reveals Distrust of Process, Congress, and Courts


On March 31, the “God Squad” met for the first time in more than three decades and, in just 15 minutes, approved a sweeping exemption under the Endangered Species Act (ESA) for oil and gas activities in the Gulf of Mexico. The decision allows those activities to proceed despite prior findings from federal wildlife experts that they could jeopardize the endangered Rice’s whale.

In a new article on the Yale Journal on Regulation and ABA Section of Administrative Law & Regulatory Practice blog, Erica Kranz, EELP senior attorney, and Andrew Mergen, faculty director of the Emmett Environmental Law & Policy Clinic, explain why the committee’s action is so unusual — and potentially consequential. Rather than following the ESA’s traditional, highly structured exemption process (which includes public notice, hearings, and detailed factual analysis), the committee relied for the first time on a separate “national security” exemption provision. That approach bypassed typical safeguards and rested entirely on a determination from the Secretary of Defense, overriding scientific findings without public input or deliberation.
