Timeline

The Department of Homeland Security (DHS) does not have NEPA implementing regulations. DHS’s NEPA procedures are contained in Directive 023-01, Rev. 01 and Instruction Manual 023-01-001-01, Rev. 1.

Nov. 26, 2014 DHS finalized updates to its policies implementing NEPA. The updates expanded DHS’s NEPA policies to cover the Federal Emergency Management Agency (FEMA), Customs and Border Protection (CBP), and the U.S. Coast Guard, though each DHS component can issue Supplemental Instructions on NEPA compliance. The updates also added new categorical exclusions for certain non-grant and assistance FEMA activities. On Oct. 18, 2017, DHS corrected minor errors in its 2014 NEPA policy.
