SEC Climate-Related Risk Disclosure Rule Compliance Timeline

On March 6, 2024, the Securities and Exchange Commission (SEC) voted 3-2 to release its long-awaited final rule to require public companies to report on climate-related risks that materially impact their business. A subset of large companies will also be required to report their Scope 1 and 2 greenhouse gas emissions if material. The final rule narrowed some of the proposed SEC Climate-Related Risk Disclosure Rule Compliance Timeline provisions, including eliminating any requirements to report Scope 3 emissions or climate-related impacts of each line item of consolidated financial statements. The rule will be effective 60 days following publication in the Federal Register, but challenges to the rules are already being filed. Stay tuned for EELP analysis of the rule and legal challenges.
