On June 18, 2026, FERC issued an order to Eastern Gas Transmission and Storage, Inc. granting the company authorization to construct, operate, and maintain natural gas transportation facilities in Ohio and Pennsylvania. In its order, FERC determined that although the Commission staff’s Environmental Analysis (EA) included a section identifying and analyzing “cumulative effects” of the project, the “exercise of identifying a distinct and separate category of cumulative effects… exceeds what NEPA requires” and “has proven to ultimately disserve NEPA’s goal of supporting environmentally informed decision making without imposing undue procedural burdens.” FERC pointed to the Council on Environmental Quality’s (CEQ) rescission of its regulations requiring consideration of cumulative impacts.
