Endangered Species Act Regulations

January 21, 2025

The Trump administration issued an executive order directing agencies to “use, to the maximum extent permissible under applicable law, the ESA regulation on consultations in emergencies, to facilitate the Nation’s energy supply.” It also set out requirements for the Endangered Species Act Committee to meet at least quarterly to “ensure a prompt and efficient review of all submissions” for potential actions that could facilitate fossil energy development.

NEPA – Environmental Protection Agency

December 17, 2018

EPA announces it will no longer employ its grading system for the environmental impact statements it reviews. Section 309 of the Clean Air Act allows for EPA to review Environmental Impact Statements prepared by other agencies and requires EPA to make those reviews available to the public. Since 1984, EPA has assigned letter grades to draft Environmental Impact Statements produced by other agencies as a part of this review process. EPA cited concerns with efficiency and consistency in its decision to discontinue the letter grading system.

NEPA – Department of the Interior

August 15, 2018

Department of Interior Deputy Secretary Bernhardt issues a memo, in the form of a secretarial order, directing that environmental impact statements must be no longer than 150 pages or 300 pages for “unusually complex projects.” The Secretarial Order No. 3355 is intended to “immediately implement” certain NEPA streamlining efforts and “begin assessment of additional such opportunity” and implementation of EO 13807. The Secretarial Order also directed that Final EIS’s should be completed within one year. It directed the agency’s bureaus to identify impediments to efficient reviews and provide recommendations for streamlining the NEPA process.

NEPA – USDA / Forest Service

August 15, 2018

The Forest Service publishes an Advanced Notice of Proposed Rulemaking and Request for Comment. The proposed rule seeks to revise the Forest Service’s formal NEPA regulations as well as its internal NEPA procedures. The Forest Service requests comments on methods to improve efficiency, approaches to authorize many projects under a singular NEPA review, actions that could be categorically excluded from NEPA procedures, and ways the agency may better coordinate environmental review with other government entities.
